Both Doctors and Patients Confused by Dense Breasts

Inadequate patient assessment and/or misinterpretation of diagnostic studies are a leading contributing factor in breast cancer medical malpractice claims.


This article about the issue of breast cancer diagnosis—and the treatment of women with “dense breasts”—references a report we coauthored with The Doctors Company that analyzed 562 breast cancer medical malpractice claims from 2009 to 2014 in the CRICO Strategies Comparative Benchmark System (CBS). The analysis found 342 cases alleging a delay in the diagnosis of breast cancer with roughly half (49%) of the these cases involving inadequate patient assessment and/or misinterpretation of diagnostic studies. In addition, communication issues between providers or between providers and patients accounted for 28% of the 342 cases.
