Chronic Pain Management Malpractice Claims: Insight Into Underlying Causes

The analysis of closed malpractice claims can provide valuable insights into the various factors that may be common in cases.


This Clinical Pain Advisor article shares insights gleaned from different malpractice data analyses of pain management cases. The author cited a recent study, “A Contemporary Medicolegal Analysis of Outpatient Medication Management in Chronic Pain (Anesth Analg.),” which analyzed data from the CRICO Strategies national Comparative Benchmarking System (CBS). The researchers “hypothesized that there are identifiable patient comorbidities and behaviors as well as prescriber clinical practices associated with patient injury that may result in a malpractice claim.”
