The High Cost of Miscommunication: A Persistent Risk in Medical Liability

Communication failures are among the most persistent and costly risks in medical malpractice cases. They don’t just happen—they drive outcomes. Across a decade of claims, breakdowns in communication consistently appear as a leading factor, increasing the odds of payouts and complicating care. From provider-to-patient misunderstandings to provider-to-provider gaps, these failures often occur outside hospital walls and can derail diagnoses.

Drawn from malpractice case data spanning 2014–2024, below are five examples that show just how common and consequential these breakdowns have become.

  1. Communication failures appear in 4 out of 10 asserted medial professional liability (MPL) cases, making them some of the most consistent risk factors across a decade of claims.
  2. When communication breaks down, a case has 39% higher odds of closing with an indemnity payment. 
  3. Provider-to-patient communication failures are getting worse, not better, rising to 63% of cases, up from 58% in the prior analysis. 
  4. Most provider-to-patient communication errors happen outside the hospital, with 60% occurring in ambulatory settings. 
  5. Provider-to-provider communication breakdowns often derail diagnosis, as 27% of these cases included diagnostic failure allegations.

2025 Candello Benchmarking Report


More than $1.5 billion is lost annually from the U.S. health care system, partly due to communication failures among and between providers and patients that lead to medical malpractice claims. A new report from Candello, the national medical malpractice data collaborative of CRICO, analyzed more than 73,000 closed and 64,000 asserted cases between 2014 and 2024. It found that 40% of cases involved a communication failure, and of those, 46% resulted in an indemnity payment averaging $420,000 per case.
